District Courts Amendment Act Commencement Order 1988

PURSUANT to section 1(2) of the District Courts Amendment Act 1983, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title
  • This order may be cited as the District Courts Amendment Act Commencement Order 1988.

2 Commencement of section 7 of District Courts Amendment Act 1983
  • Section 7 of the District Courts Amendment Act 1983 shall come into force on the 1st day of January 1989.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force on 1 January 1989 section 7 of the District Courts Amendment Act 1983, which inserts a new section 96A in the District Courts Act 1947 relating to charging orders. The new section 96A (as amended by section 3 of the District Courts Amendment Act 1987) provides that a person who has obtained a judgment or order for the payment of money may apply to the District Court for a charging order in respect of certain property of the judgment debtor.
