Pursuant to section 65(2)(a) of the Conservation Act 1987, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

Order

1 Title and Commencement
  • (1) This order may be cited as the Christchurch City (Reserves) Empowering Act (Ministerial Responsibility) Order 1989.

    (2) This order shall come into force on the 28th day after the date of its notification in the Gazette.

2 Amending definition of Minister in section 2 of Act
  • Section 2 of the Christchurch City (Reserves) Empowering Act 1971 is hereby amended by omitting from the definition of the term Minister the word Lands, and substituting the word Conservation.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which is made under section 65(2)(a) of the Conservation Act 1987 and comes into force 28 days after its notification in the Gazette, amends the definition of the term Minister in section 2 of the Christchurch City (Reserves) Empowering Act 1971 so that it now means the Minister of Conservation. Formerly it meant the Minister of Lands.

The following provisions in the Act affect the Minister:

  • (a) no part of Hagley Park can be appropriated to provide car parking places without the Minister’s consent (section 5(2)):

  • (b) the Minister can direct the Christchurch City Council to pay into its Reserves Account sums of money in respect of road reserves, and money in that Account can be applied only in the purchase, improvement, or development of public reserves (section 11).
