  • Preamble

    WHEREAS the Taranaki Maori Trust Board recently held an election for membership of the Trust Board in 5 of the 8 divisions of beneficiaries by postal ballot pursuant to section 50 of the Maori Trust Boards Act 1955:

    And whereas those divisions of beneficiaries in which elections were necessary were Atiawa, Ngati Mutunga, Ngati Ruanui, Ngaruahine, and Taranaki:

    And whereas by virtue of section 46 of the Maori Trust Boards Act 1955 public notice is required to be given to beneficiaries that nominations are called for election to membership of a Trust Board:

    And whereas that public notice is also required to invite applications from qualified persons for inclusion of their names in the roll of beneficiaries:

    And whereas the date upon which the roll of beneficiaries closes for the election is required to be the same date as that fixed as the latest date for the lodging of nominations under section 47 of the Maori Trust Boards Act 1955:

    And whereas the latest date fixed by the Taranaki Maori Trust Board for the lodging of nominations for the election was the 31st day of July 1990:

    And whereas the date upon which the roll of beneficiaries closes for the election was initially fixed by the Taranaki Maori Trust Board as the 31st day of August 1990 and was later amended by public notice to the 17th day of August 1990:

    And whereas the effect of the inconsistency of these dates created an irregularity at the election:

    And whereas it would not be proper or desirable to validate that irregularity under section 55 of the Maori Trust Boards Act 1955:

NOW THEREFORE, PURSUANT to section 55A of the Maori Trust Boards Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:

1 Title
  • This order may be cited as the Taranaki Maori Trust Board Order 1990.

2 Election declared invalid
  • The election of members of the Taranaki Maori Trust Board held in 1990 is hereby declared invalid.

3 Fresh election to be held
  • A fresh election of members of the Taranaki Maori Trust Board to represent the 5 relevant divisions of beneficiaries shall be held in accordance with the following provisions:

    • (a) Not later than the 14th day of November 1990 the Secretary of the Board shall cause public notice to be given to every beneficiary of the Board who is enrolled in the relevant divisions of beneficiaries of the fact that nominations are called for election to membership of the Board for the ensuing term, the method of lodging nominations, and the latest date, as fixed by paragraph (b) of this clause, by which nominations must be lodged with the Secretary of the Board:

    • (b) Nominations shall be lodged with the Secretary of the Board not later than the 14th day of December 1990:

    • (c) Where an election is required, the Secretary of the Board shall, not later than the 14th day of January 1991, post to each beneficiary shown on the roll of beneficiaries as entitled to vote at the election a printed ballot paper setting out the full names of each candidate for election, the method of marking the ballot paper to indicate the beneficiary's preference, the address to which the ballot paper is to be returned, and the latest time for its return:

    • (d) Ballot papers shall, not later than the 14th day of February 1991, be posted to or lodged with the Returning Officer appointed for the purpose of the election by the Minister:

    • (e) The Secretary of the Board shall, not later than the 28th day of February 1991, forward to the General Manager of the Iwi Transition Agency the names of the persons elected as members of the Board for the relevant divisions of beneficiaries:

    • (f) Subject to the preceding provisions of this clause, the provisions of the Maori Trust Boards Act 1955 shall apply to and in respect of the election
