District Courts Amendment Act Commencement Order 1992

PURSUANT to section 1(3) of the District Courts Amendment Act 1989, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title
  • This order may be cited as the District Courts Amendment Act Commencement Order 1992.

2 Commencement of section 6 of the District Courts Amendment Act 1989
  • Section 6 of the District Courts Amendment Act 1989 shall come into force on the 1st day of July 1992.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force, on 1 July 1992, section 6 of the District Courts Amendment Act 1989. That section repeals section 55 of the District Courts Act 1947, and substitutes a new section.

The new section 55 provides that the District Court may, on application made in accordance with the District Courts Rules,—

  • (a) Issue a commission, request, or order to examine witnesses abroad for the purposes of any proceedings:

  • (b) Direct and supervise the service abroad of any process of the Court.
