Transport (Vehicle and Driver Registration and Licensing) Amendment Act Commencement Order 1994

PURSUANT to section 1(2) of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title
  • This order may be cited as the Transport (Vehicle and Driver Registration and Licensing) Amendment Act Commencement Order 1994.

2 Commencement of certain provisions of Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992
  • Sections 4, 5(5), 9(3), 15, 21(4), and 22 of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992 shall come into force on the 1st day of December 1994.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force, on 1 December 1994, sections 4, 5(5), 9(3), 15, 21(4), and 22 of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992.

Section 4 repeals section 6 of the principal Act and Schedule 1 to that Act. Section 6 and Schedule 1 exempted certain vehicles from registration and licensing, and in future such exemptions shall be granted by or under regulations made under section 35A of the principal Act.

Sections 5(5), 9(3), and 15 amend the principal Act to reflect the fact that fees for applications for registration and licensing, which formerly were prescribed by Schedule 2 to that Act, are to be prescribed by regulations. The fees are now set out in the Transport (Vehicle and Driver Registration and Licensing Fees) Regulations 1994.

Section 21(4) inserts into section 48 of the principal Act new subsection (1A), which empowers the Director of Land Transport Safety to prescribe the theoretical tests to be undergone by applicants for drivers licences.

Section 22 repeals Schedule 2 to the principal Act.
