This note is not part of the order, but is intended to indicate its general effect.
This order brings into force, on 1 January 1995, the Temporary Safeguard Authorities Amendment Act 1994. The Act and a number of other Acts that come into force on 1 January 1995 give effect to provisions of the various trade agreements that form part of the Agreement establishing the World Trade Organization. The Act implements provisions of the Uruguay Round Agreement on Safeguards and the Uruguay Round Agreement on Agriculture.
The principal amendments relate to the change from the criterion of material injury, in relation to an industry, to serious injury, the extension of the term industry to include producers of goods that are substitutable for imported goods, and the matters to which an Authority is required to have regard in determining injury to an industry. The principal Act is also amended to provide that measures taken to protect an industry must not be incompatible with New Zealand's obligations under the Agreement establishing the World Trade Organization.
