These regulations are administered by the Ministry of Justice.


Pursuant to section 64 of the Marriage Act 1955 and (in relation only to regulation 3(d) and form 4) section 88(1)(b) of the Births, Deaths, and Marriages Registration Act 1995, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following regulations.

Regulations

1 Title and commencement
  • (1) These regulations may be cited as the Marriage (Forms) Regulations 1995.

    (2) These regulations shall come into force on the day after the date of their notification in the Gazette.

2 Interpretation
  • In these regulations, unless the context otherwise requires,—

    • (b) reference to a form of a particular number is a reference to the form bearing that number set out in the Schedule.

3 Forms
  • There are hereby prescribed—

    • (a) subject to paragraphs (ab) and (b), for a notice of intended marriage under section 23(1) of the Act, form 1:

    • (ab) for a notice of intended marriage under section 23(1) of the Act where the parties are currently in a civil union with each other and wish to change the form of their relationship into marriage under section 18 of the Civil Union Act 2004, form 1A:

    • (b) for a notice of intended marriage under section 23(1) where the bride and groom are ordinarily resident outside New Zealand, form 2:

    • (d) subject to paragraph (da), for a form to be issued under section 24(1)(b) of the Act by a Registrar for the purpose of returning (under section 56(1)(a) of the Births, Deaths, Marriages, and Relationships Registration Act 1995) information relating to marriages solemnised by marriage celebrants, exempt religious bodies, or under section 32 of the Act, form 4:

    • (da) for a form to be issued under section 24(1)(b) of the Act by a Registrar for the purpose of returning (under section 56(1)(a) of the Births, Deaths, Marriages, and Relationships Registration Act 1995) information relating to marriages solemnised by marriage celebrants, exempt religious bodies, or under section 32 of the Act, which are a change in the form of relationship from civil union, form 4A:

    • (e) for a notice to the Registrar-General under subsection (1) of section 41 of the Act from a person who intends to be married in a country other than New Zealand and according to the law of that country and who desires to obtain a certificate under subsection (4) of that section, form 5:

    • (f) for a certificate under section 41(4) of the Act that after proper notices have been given no lawful impediment to a marriage has been shown to the Registrar-General to exist, form 6:

    • (g) for a notice to a Registrar under section 42(1) of the Act from a citizen of a Commonwealth country or the Republic of Ireland resident in New Zealand who desires to marry outside New Zealand, form 7:

    • (h) for a certificate issued by a Registrar under subsection (5) of section 42 of the Act that notice of an intended marriage has been given under subsection (1) of that section, form 8:

    • (i) for a certificate from a New Zealand representative under section 43(1) of the Act that the representative has attended the marriage of a New Zealand citizen in a country other than New Zealand and is satisfied that the marriage has been solemnised in accordance with the formalities of the law of that other country, form 9.

1 General

2 Status of reprints
  • Under section 16D of the Acts and Regulations Publication Act 1989, reprints are presumed to correctly state, as at the date of the reprint, the law enacted by the principal enactment and by the amendments to that enactment. This presumption applies even though editorial changes authorised by section 17C of the Acts and Regulations Publication Act 1989 have been made in the reprint.

3 How reprints are prepared
  • A number of editorial conventions are followed in the preparation of reprints. For example, the enacting words are not included in Acts, and provisions that are repealed or revoked are omitted. 4 Changes made under section 17C of the Acts and Regulations Publication Act 1989
  • Section 17C of the Acts and Regulations Publication Act 1989 authorises the making of editorial changes in a reprint as set out in sections 17D and 17E of that Act so that, to the extent permitted, the format and style of the reprinted enactment is consistent with current legislative drafting practice. Changes that would alter the effect of the legislation are not permitted.

    A new format of legislation was introduced on 1 January 2000. Changes to legislative drafting style have also been made since 1997, and are ongoing. To the extent permitted by section 17C of the Acts and Regulations Publication Act 1989, all legislation reprinted after 1 January 2000 is in the new format for legislation and reflects current drafting practice at the time of the reprint.

    In outline, the editorial changes made in reprints under the authority of section 17C of the Acts and Regulations Publication Act 1989 are set out below, and they have been applied, where relevant, in the preparation of this reprint:

    • omission of unnecessary referential words (such as of this section and of this Act)

    • format of definitions (eg, the defined term now appears in bold type, without quotation marks)

    • format of dates (eg, a date formerly expressed as the 1st day of January 1999 is now expressed as 1 January 1999)

    • position of the date of assent (it now appears on the front page of each Act)

    • punctuation (eg, colons are not used after definitions)

    • Parts numbered with roman numerals are replaced with arabic numerals, and all cross-references are changed accordingly

    • case and appearance of letters and words, including:

      • format of headings (eg, headings where each word formerly appeared with an initial capital letter followed by small capital letters are amended so that the heading appears in bold, with only the first word (and any proper nouns) appearing with an initial capital letter)

      • small capital letters in section and subsection references are now capital letters

    • schedules are renumbered (eg, Schedule 1 replaces First Schedule), and all cross-references are changed accordingly

    • running heads (the information that appears at the top of each page)

    • format of two-column schedules of consequential amendments, and schedules of repeals (eg, they are rearranged into alphabetical order, rather than chronological).
