This note is not part of the order, but is intended to indicate its general effect.
This order brings into force on 30 October 1995, sections 3(3), 5(1), 5(2), 9(1), 9(4), 10(1), 10(2), 12, 14(1), and 16 of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992.
Section 3(3) amends section 5 of the Transport (Vehicle and Driver Registration and Licensing) Act 1986, which requires motor vehicles to be registered and licensed. The amendment adds a new offence provision making it an offence to sell an unlicensed motor vehicle that is required to be licensed under Part 1 of that Act.
Section 5(1) amends section 7 of that Act, which relates to applications for registration. A new subsection (1) is substituted which sets out the matters that must be specified by an applicant for the registration of a motor vehicle.
Section 5(2) further amends section 7 of that Act. A new subsection (1A) is inserted which sets out the types of legal persons who are able to become the registered owner of a motor vehicle.
Section 9(1) amends section 10 of that Act, which relates to applications for a licence for a motor vehicle. A new subsection (1) is substituted which sets out the matters that must be specified by an applicant for a licence for a motor vehicle.
Section 9(4) repeals subsections (4) and (5) of section 10 of that Act.
Section 10(1) repeals subsections (2) to (4) of section 11 of that Act, which relates to the duration of licences. Section 10(2) makes a consequential amendment to that section 11.
Section 12(1) amends section 19 of that Act, which relates to the details of registers to be supplied to applicants. A new subsection (2) is substituted which sets out the details relating to a specified motor vehicle that a person who makes an application to the Registrar shall be entitled to receive.
Sections 12(2) to 12(4) amend section 19 of that Act to provide that the Registrar may decline to issue a certificate of details on the register in certain circumstances and to provide a right of appeal to the Attorney-General against the Registrar's decision.
Section 14(1) repeals sections 22 to 24 of that Act, and substitutes a new section 22 which relates to applications by persons acquiring ownership of a motor vehicle to be registered as the owner of the vehicle.
Section 16 amends section 26 of that Act. The amendments concern offences relating to the change of ownership of a motor vehicle.
