Transport (Vehicle and Driver Registration and Licensing) Amendment Act Commencement Order (No 3) 1995

PURSUANT to section 1(3) of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1995, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force, on 30 October 1995, sections 3, 4, 5, and 7 of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1995.

Section 3 inserts a new section 6A into the Transport (Vehicle and Driver Registration and Licensing) Act 1986. The new section 6A provides that a person applying to register, relicense, or change the ownership of a motor vehicle, or applying for the issue of replacement or personalised registration plates must produce a current vehicle inspection certificate if required by the Registrar to do so.

Section 4 amends section 7 of that Act, which relates to applications for registration of a motor vehicle. It substitutes a new paragraph (ba) into section 7(2) which requires that a current vehicle inspection certificate be produced by the person applying for the registration of a motor vehicle. Section 4(2) repeals subsection (2A) of section 7 (which was enacted by section 5(4) of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992.

Section 5(1) repeals subsection (1A) of section 10 of that Act, which relates to applications for a licence for a motor vehicle. That subsection was enacted by section 9(2) of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992.

Sections 5(2) and 5(3) further amend section 10 of that Act. Section 5(3) inserts a new subsection (2A) into section 10. That subsection provides specific rules for the payment of fees and levies under section 10(2) in the case where a person becomes the owner of a motor vehicle in respect of which the licence has expired.

Sections 5(4), 5(5), and 5(6) amend the Transport (Vehicle Registration and Licensing) Regulations 1994.

Section 7(1) makes an amendment to section 25(1) of that Act consequential upon the repeal of section 24 of that Act by section 14 of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992.

Section 7(2) repeals section 25(2) of that Act, which provides that the person selling or otherwise disposing of a motor vehicle is primarily liable for the payment of the fee for the endorsement of particulars of a change of ownership.
