Waikato Raupatu Claims Settlement Act Commencement Order 1995

PURSUANT to section 1(2) of the Waikato Raupatu Claims Settlement Act 1995, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title
  • This order may be cited as the Waikato Raupatu Claims Settlement Act Commencement Order 1995.

2 Commencement of majority of provisions of Act
  • The provisions of the Waikato Raupatu Claims Settlement Act 1995 that are not in force at the date of the making of this order (other than the provisions of section 25 of subsections (2) and (3) of section 26, of sections 28, 29, and 32(1), and of Schedule 4) shall come into force on the 15th day of November 1995.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

Subject to 6 exceptions, this order brings into force, on 15 November 1995, the provisions of the Waikato Raupatu Claims Settlement Act 1995 that were not in force on the date of the making of this order.

The only provisions of that Act that were in force on that date were sections 15, 37, and 38 (which sections came into force on the day on which that Act received the Royal assent).

The only provisions of that Act that will not be in force on 15 November 1995 are the provisions of—

  • (a) Section 25 (which amends section 6P of the Conservation Act 1987 and which is to come into force on 1 September 1996); and

  • (b) Subsections (2) and (3) of section 26 (which relate to the return to Maori ownership of the Onewhero forest land and the Maramarua forest land and which are to come into force on dates to be appointed by further Orders in Council); and

  • (c) Section 28 (which provides for the dissolution of the Tainui Maori Trust Board and which is to come into force on a date to be appointed by a further Order in Council); and

  • (d) Section 29 (which provides for the final accounts of the Tainui Maori Trust Board and which is to come into force on a date to be appointed by a further Order in Council), and

  • (e) Section 32(1) (which amends the Transit New Zealand Act 1989 and which is to come into force on a date (which cannot be before 1 July 1996) to be appointed by a further Order in Council); and

  • (f) Schedule 4 (which contains provisions relating to the dissolution of the Tainui Maori Trust Board and which, like section 28, is to come into force on a date appointed by a further Order in Council).
