Domestic Violence Act Commencement Order 1996


Note

This order is administered in the Ministry of Justice.


PURSUANT to sections 1(2) and 1(3) of the Domestic Violence Act 1995, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

1 Title
  • This order may be cited as the Domestic Violence Act Commencement Order 1996.

2 Interpretation
  • In this order,—

    • (b) Expressions defined in the Act have the meanings as defined.

3 Commencement of Domestic Violence Act 1995
  • (1) Subject to subclause (2) of this clause, the Act, other than—

    • (a) Part 6; and

    • (b) Section 29, except to the extent that it comes into force, by virtue of section 30(1) of the Act, on the date appointed by this order,—

    shall come into force on the 1st day of July 1996.

    (2) Part 6 of the Act shall come into force on the 1st day of July 1996, but sections 108 to 120 of the Act shall come into force on that date only for the purposes of the public registers maintained pursuant to the public register provisions specified in the Schedule to this order.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force, on 1 July 1996, the Domestic Violence Act 1995.

There are two qualifications to the Act coming into force on that date:

  • (a) Section 29 of the Act, which relates to court registrars authorising the provision of programmes for protected persons, comes into force only in respect of persons who are not children, ie persons who are 17 years of age or older; and

  • (b) Sections 108 to 120 of the Act come into force on that date only for the purposes of the public registers maintained under the public register provisions listed in the Schedule to the order. This means that directions under Part 6 of the Act about the non-disclosure of information relating to a protected person's whereabouts can be made only in respect of information on those registers.
