Fisheries (Auckland and Kermadec Areas Commercial Fishing) Amendment Regulations 1997

PURSUANT to section 89 of the Fisheries Act 1983 and sections 296 and 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.

  • The following regulations are consequentially revoked:

    • (a) Regulation 3(2) of the Fisheries (Auckland and Kermadec Areas Commercial Fishing) Regulations 1986, Amendment No 6:

    • (b) Regulation 16 of the Fisheries (Auckland and Kermadec Areas Commercial Fishing) Regulations 1986, Amendment No 7.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 April 1997, amend the Fisheries (Auckland and Kermadec Areas Commercial Fishing) Regulations 1986 by removing the provision in regulation 22A(2) relating to the lawfulness of possession on any one day of 1200 kg of scallops in quota management areas 1 and 9. The provision is no longer necessary in light of the system of annual catch entitlements introduced in July 1996, which is based on a seasonal rather than a daily limit on scallop catch.
