  • Preamble

    WHEREAS—

    • A. An election of the members of the Ngati Whatua o Orakei Maori Trust Board should have been held by 17 January 1997:

    • B. Nominations for the election closed on 15 November 1996, and the number of nominations exceeded the number of members to be elected so that an election was necessary:

    • C. Ballot papers for the election should have been posted by 15 December 1996, but ballot papers were not posted and an election was not held:

    • D. Section 55 of the Maori Trust Boards Act 1955 authorises the Governor-General by Order in Council published in the Gazette to extend the time within which anything is required to be done, or validate anything done before or after the time required or irregularly done in matter of form, or make other provision as is thought fit:

NOW THEREFORE, PURSUANT to section 55 of the Maori Trust Boards Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following order.

1 Title and commencement
  • (1) This order may be cited as the Ngati Whatua o Orakei Maori Trust Board Order 1997.

    (2) This order comes into force on the day after the date of its notification in the Gazette.

2 Interpretation
  • In this order, unless the context otherwise requires,—

    Board means Ngati Whatua o Orakei Maori Trust Board

    Secretary means the secretary of the Board.

3 New election of members of Board
  • A fresh election of members of the Board must be held in accordance with clauses 4 to 9.

4 Nominations
  • (1) The secretary must, not later than 12 July 1997, cause public notice to be given to beneficiaries of the Board of the fact that nominations are being called again for election to membership to the Board.

    (2) The notice must state—

    • (a) The method of lodging nominations; and

    • (b) The latest date by which nominations must be lodged with the secretary.

5 Date for lodging nominations
  • Nominations must be lodged with the secretary not later than 12 August 1997.

6 Posting of ballot papers and declaration forms if election necessary
  • If an election is necessary, the secretary must, not later than 12 September 1997, post to each beneficiary shown on the roll of beneficiaries as entitled to vote at the election—

    • (a) A printed ballot paper setting out—

      • (i) The full names of each candidate for election; and

      • (ii) The method of marking the ballot paper to indicate each beneficiary's preference; and

      • (iii) The address to which the ballot paper is to be returned; and

      • (iv) The date by which the ballot paper is to be returned; and

7 Return of ballot papers
  • Ballot papers must, not later than 12 October 1997, be posted or lodged with the returning officer appointed for the purpose by the Minister of Maori Affairs.

8 Results to be forwarded to Ministry of Maori Development
  • The secretary must, not later than 30 October 1997, forward to the chief executive of the Ministry of Maori Development the names of the persons elected as members of the Board.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the day after the date of its notification in the Gazette, specifies a new timetable for the election of members of Ngati Whatua o Orakei Maori Trust Board, which should have been held by 17 January 1997.
