Freshwater Fisheries Amendment Regulations 1997


Note

These regulations are administered in the Department of Conservation.


PURSUANT to sections 48 and 48A of the Conservation Act 1987, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.

1 Title and commencement
  • (1) These regulations may be cited as the Freshwater Fisheries Amendment Regulations 1997, and are part of the Freshwater Fisheries Regulations 19831 (the principal regulations).

    (2) These regulations come into force on 1 October 1997.

2 Interpretation
3 Classes and forms of licences
  • The principal regulations are amended by revoking regulation 4, and substituting the following regulation:

    • Licences issued to take acclimatised fish must be in the forms and for the classes fixed by notice in the Gazette.

4 Licence fees
5 Reduction or waiver of fees
  • Regulation 15 of the principal regulations is amended by omitting the words these regulations prescribing, and substituting the words a Gazette notice fixing.

6 Revocations
  • The following regulations are revoked:

    • (a) Regulations 5 to 7 and the Second Schedule of the principal regulations:

    • (b) Regulation 4 of the Freshwater Fisheries Regulations 1983, Amendment No 1:

    • (c) Regulation 2 of the Freshwater Fisheries Regulations 1983, Amendment No 10:

    • (d) Regulation 2 of the Freshwater Fisheries Regulations 1983, Amendment No 11:

    • (e) Regulation 7 of the Freshwater Fisheries Regulations 1983, Amendment No 18:

    • (f) The Freshwater Fisheries Regulations 1983, Amendment No 19.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 October 1997, amend or revoke those provisions of the Freshwater Fisheries Regulations 1983 relating to classes of licences and licence fees. The definition of licence is also amended. The Conservation Amendment Act (No 3) 1996 amended the Conservation Act 1987 to allow the forms and classes of licences to fish for sports fish, the scope and effect of licences to fish for sports fish, the availability of licences to fish for sports fish, and the fees payable for those licences to be fixed by notice in the Gazette.
