PURSUANT to section 89 of the Fisheries Act 1983 and sections 297 and 298 of the Fisheries Act 1996, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.

1 Title and commencement
  • (1) These regulations may be cited as the Fisheries (South-East Area Amateur Fishing) Amendment Regulations 1997, and are part of the Fisheries (South-East Area Amateur Fishing) Regulations1 (the principal regulations).

    (2) These regulations come into force on the 28th day after the date of their notification in the Gazette.

2 Ngai Tahu eel fishery at Lake Forsyth
  • The principal regulations are amended by revoking regulation 7 (as substituted by regulation 2 of the Fisheries (South-East Area Amateur Fishing) Regulations 1986, Amendment No 7), and substituting the following regulation:

    • 7 

      (1) No person who does not belong to the Ngai Tahu iwi may take any eels from Lake Forsyth.

      (2) For the purposes of this regulation the term Ngai Tahu iwi means the collective of those individuals who descend from the primary hapu of Ngai Tahu and Ngati Mamoe, namely, Kati Kuri, Kati Irakehu, Kati Huirapa, Ngai Tuahuriri, and Kai Te Ruahikihiki.

3 Revocation
  • The Fisheries (South-East Area Amateur Fishing) Regulations 1986, Amendment No 7 are revoked.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the Fisheries (South-East Area Amateur Fishing) Regulations 1986 to correct the definition of Ngai Tahu iwi in relation to the eel fishery at Lake Forsyth.
