Antarctica (Environmental Protection) Act Commencement Order 1998

PURSUANT to section 1(3) of the Antarctica (Environmental Protection) Act 1994, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following order.

  • This order may be cited as the Antarctica (Environmental Protection) Act Commencement Order 1998.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force, on 23 January 1998, the bulk of the Antarctica (Environmental Protection) Act 1994. The Protocol on Environmental Protection to the Antarctic Treaty entered into force in international law on 14 January 1998.

Some provisions of the Act came into force on 1 February 1995 (such as the principal prohibition on mineral resource activities in Antarctica).

The provisions being brought into force by this order relate mainly to environmental impact assessments, measures for the conservation of Antarctic fauna and flora and protected areas, and waste disposal in Antarctica.
