PURSUANT to section 87(2) of the Biosecurity Act 1993, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, makes the following order.

1 Title and commencement
  • (1) This order may be cited as the Biosecurity (Northland Regional Pest Management Strategies) Crown Obligations Order 1998.

    (2) This order comes into force on 10 July 1998.

2 Interpretation
  • In this order, unless the context otherwise requires,—

    Financial year has the same meaning as in section 2(1) of the Public Finance Act 1989

    Northland Regional Pest Management Strategies means the pest management strategy approved by the Northland Regional Council on 15 April 1998.

3 Pest control on land administered by Department of Conservation
  • (1) The Northland Regional Pest Management Strategies applies to the Crown to the extent that the Crown must (so far as is practicable) carry out work in accordance with that strategy, to the value of $130,500 each financial year, on land owned by the Crown and administered by the Department of Conservation under the Conservation Act 1987 or under any Act listed in Schedule 1 of the Conservation Act 1987.

    (2) The obligations in subclause (1) are subject to the limitations in regulation 4.

4 Additional limitations on work
  • (1) The Crown's obligation to carry out work applies only to the pests or groups of pests specified in the Schedule and the obligation does not exceed the amount specified for that pest or group of pests.

    (2) Work to the value of $25,000 (of the total of $50,000 of work) carried out by the Crown in relation to wild ginger may only be carried out in accordance with a programme in an operational plan for the implementation of the Northland Regional Pest Management Strategies, to be undertaken by a group of people within the locality specified in the operational plan.

5 Application of order
  • This order applies to the financial years commencing on 1 July 1998, 1 July 1999, and 1 July 2000.
