PURSUANT to section 87(2) of the Biosecurity Act 1993, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, makes the following order.

1 Title and commencement
  • (1) This order may be cited as the Biosecurity (Waikato Regional Pest Management Strategy) Crown Obligations Order 1998.

    (2) This order comes into force on 10 July 1998.

2 Interpretation
  • In this order, unless the context otherwise requires,—

    Financial year has the same meaning as in section 2(1) of the Public Finance Act 1989

    General administrative functions means setting standards, inspection, enforcement, monitoring, surveillance, provision of advice or information, education, direct control (including biological control) of pests, research into biological control, administration, or management

    Waikato Regional Pest Management Strategy means the pest management strategy approved by the Waikato Regional Council on 27 June 1996.

3 Pest control on land administered by Department of Conservation
  • (1) The Waikato Regional Pest Management Strategy applies to the Crown to the extent that the Crown must,—

    • (a) So far as is practicable, carry out work in accordance with that strategy, to the value of $70,500 each financial year, on land owned by the Crown and administered by the Department of Conservation under the Conservation Act 1987 or under any Act listed in the Schedule 1 of the Conservation Act 1987:

    • (b) Pay the following amounts for each specified financial year to the Waikato Regional Council for general administrative functions as specified in that strategy:

      • (i) $62,380 for the financial year commencing on 1 July 1998:

      • (ii) $63,628 for the financial year commencing on 1 July 1999:

      • (iii) $64,900 for the financial year commencing on 1 July 2000.

    (2) The obligations in subclause (1)(a) are subject to the limitations in regulation 4.

4 Additional limitations on work
  • (1) The Crown's obligation to carry out work applies only to the pests or groups of pests specified in the Schedule and the obligation does not exceed the amount specified for that pest or group of pests.

    (2) The work carried out by the Crown in relation to possums may only be carried out in accordance with a programme in an operational plan for the implementation of the Waikato Regional Pest Management Strategy, to be undertaken by a group of people within the locality specified in the operational plan.

5 Application of order
  • This order applies to the financial years commencing on 1 July 1998, 1 July 1999, and 1 July 2000.
