PURSUANT to section 87(2) of the Biosecurity Act 1993, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, makes the following order.

1 Title and commencement
  • (1) This order may be cited as the Biosecurity (Otago Regional Pest Plant Management Strategy) Crown Obligations Order 1998.

    (2) This order comes into force on 10 July 1998.

2 Interpretation
  • In this order, unless the context otherwise requires,—

    Financial year has the same meaning as in section 2(1) of the Public Finance Act 1989

    General administrative functions means setting standards, inspection, enforcement, monitoring, surveillance, provision of advice or information, education, direct control (including biological control) of pests, research into biological control, administration, or management

    Otago Regional Pest Plant Management Strategy means the pest management strategy approved by the Otago Regional Council on 8 May 1996.

3 Pest control on land administered by Department of Conservation
  • (1) The Otago Regional Pest Plant Management Strategy applies to the Crown to the extent that the Crown must,—

    • (a) So far as is practicable, carry out work in accordance with that strategy on land owned by the Crown and administered by the Department of Conservation under the Conservation Act 1987 or under any Act listed in Schedule 1 of the Conservation Act 1987

      • (i) To the value of $244,000 in the financial year commencing 1 July 1998:

      • (ii) To the value of $255,550 in the financial year commencing 1 July 1999:

      • (iii) To the value of $294,825 in the financial year commencing 1 July 2000:

    • (b) Pay the following amounts for each specified financial year to the Otago Regional Council for general administrative functions as specified in that strategy:

      • (i) $26,425 in the financial year commencing 1 July 1998:

      • (ii) $27,606 in the financial year commencing 1 July 1999:

      • (iii) $28,847 in the financial year commencing 1 July 2000.

    (2) The obligations in subclause (1)(a) are subject to the limitations in regulation 4.

4 Additional limitations on work
  • (1) The Crown's obligation to carry out the work specified in regulation 3(1)(a) applies only to the pests or groups of pests specified in the Schedule and the obligation does not exceed the amount specified for each financial year in respect of that pest or group of pests.

    (2) The value of work carried out for old man's beard in each financial year must not be less than $4,000.

5 Application of order
  • This order applies to the financial years commencing on 1 July 1998, 1 July 1999, and 1 July 2000.

This order, which comes into force on 10 July 1998, sets out the Crown's obligations in respect of the Otago Regional Pest Plant Management Strategy.
