Hazardous Substances and New Organisms Act (New Organisms) Commencement Order 1998

This order is administered in the Ministry for the Environment.


PURSUANT to section 1(2) of the Hazardous Substances and New Organisms Act 1996, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following order.

1 Title
  • This order may be cited as the Hazardous Substances and New Organisms Act (New Organisms) Commencement Order 1998.

2 Commencement of Hazardous Substances and New Organisms Act for purposes relating to new organisms
  • The following provisions of the Hazardous Substances and New Organisms Act 1996 come into force on 29 July 1998 for the purpose of applying the Act to new organisms and, in particular:

    Sections 10 and 12 in so far as they relate to provisions brought into force by this order:

    Section 13 in so far as it relates to new organisms:

    Sections 20 to 24 in so far as they relate to provisions brought into force by this order:

    Section 25 in so far as it relates to new organisms:

    Section 26:

    Sections 27 in so far as it relates to new organisms:

    Sections 34 to 45:

    Section 46 in so far as it relates to the provisions of sections 47, 48, and 49 as brought into force by this order:

    Section 47(1) in so far as it relates to new organisms:

    Schedule 6 in relation to the Hamster Importation and Control Regulations 1972 and the Biosecurity (Transition) Regulations 1995.

Explanatory Note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force on 29 July 1998, the provisions of the Hazardous Substances and New Organisms Act 1996 for the purpose of applying that Act to new organisms.

The commencement of Schedule 4 of the Hazardous Substances and New Organisms Act 1996 also brings Part 2 of the Biosecurity Amendment Act 1997 into force.
