These regulations are administered by the Ministry of Social Development.

Pursuant to section 132 of the Social Security Act 1964, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.

Regulations

1 Title and commencement

(1)

These regulations may be cited as the Social Security (Supported Living Payments Benefit) Regulations 1998.

(2)

These regulations come into force on 1 September 1998.

Regulation 1(1): amended, on 15 July 2013, by section 97 of the Social Security (Benefit Categories and Work Focus) Amendment Act 2013 (2013 No 13).

1A Renaming of these regulations, and references to their previous name

These regulations are the Social Security (Invalid’s Benefit) Regulations 1998 as renamed on 15 July 2013 by the Social Security (Benefit Categories and Work Focus) Amendment Act 2013.

After 14 July 2013 a reference in an enactment or in a document to the Social Security (Invalid’s Benefit) Regulations 1998 must, unless the context otherwise requires, be read as a reference to the Social Security (Supported Living Payments Benefit) Regulations 1998.

Regulation 1A: inserted, on 15 July 2013, by section 97 of the Social Security (Benefit Categories and Work Focus) Amendment Act 2013 (2013 No 13).

2 Minimum period for which restricting sickness, injury, or disability must be expected to continue

For the purposes of section 40B(2)(a) of the Social Security Act 1964, the minimum period of time for which a person’s restricting sickness, injury, or disability must be expected to continue is 2 years.
