PURSUANT to section 89 of the Fisheries Act 1983 and sections 297 and 298 of the Fisheries Act 1996, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.

1 Title and commencement
  • (1) These regulations may be cited as the Fisheries (South-East Area Amateur Fishing) Amendment Regulations (No 2) 1998, and are part of the Fisheries (South-East Area Amateur Fishing) Regulations 19861 (the principal regulations).

    (2) These regulations come into force on the 28th day after the date of their notification in the Gazette.

2 Restriction on taking cockles from Port Levy
  • Regulation 7A of the principal regulations is amended by revoking subclause (1), and substituting the following subclause:

    • (1) No person may take any cockle from the Port Levy area during the period 5 November 1998 to 30 September 2001 (both dates inclusive), or be in possession of any cockle taken from that area during that period.

3 Handgathering of dredge oysters
  • The principal regulations are amended by inserting, after regulation 7B, the following regulation:

    • 7C 

      (1) Despite regulations 19 and 23 of the Fisheries (Amateur Fishing) Regulations 19862, any person may take dredge oysters from the waters of the South-East (Coast) Fishery Management Area (excluding the waters surrounding the Chatham Islands) at any time by the method of handgathering, without limit as to size or season, and may possess any dredge oysters so taken.

      (2) In this regulation, dredge oyster means a shellfish of the species Tiostrea chilensis.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force 28 days after their notification in the Gazette, amend the Fisheries (South-East Area Amateur Fishing) Regulations 1986 by—

  • (a) Extending for a further 3 years (to September 2001) the restriction on taking cockles from Port Levy; and

  • (b) Providing for the handgathering of dredge oysters in the South-East (Coast) Fishery Management Area waters other than the Chatham Islands. No size or season limits will apply, so long as the dredge oysters are handgathered.
