Summary Proceedings Amendment Regulations (No 6) 1998


Note

These regulations are administered in the Ministry of Justice and the Department for Courts.


PURSUANT to section 212 of the Summary Proceedings Act 1957, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.

1 Title and commencement
  • (1) These regulations may be cited as the Summary Proceedings Amendment Regulations (No 6) 1998, and are part of the Summary Proceedings Regulations 19581 (the principal regulations).

    (2) These regulations come into force on 1 March 1999.

2 Amendments to form 5B
  • Form 5B in Schedule 1 of the principal regulations is amended—

    • (a) By omitting the words section 58B of the Transport Act 1962, and substituting the words section 69 of the Land Transport Act 1998

    • (b) By omitting the words section 58(4)(a) of the Transport Act 1962, and substituting the words section 77(3)(a) of the Land Transport Act 1998:

    • (c) By omitting the words being a summary offence against section 58(1)(a) of the Transport Act 1962, and substituting the words being an offence against section 56(1) of the Land Transport Act 1998:

    • (d) By omitting the words being a summary offence against section 58(1)(f) of the Transport Act 1962, and substituting the words being an offence against section 57(1) of the Land Transport Act 1998.

3 Amendments to form 9A
  • Form 9A in Schedule 1 of the principal regulations is amended by omitting the words section 41B of the Transport Act 1962, and substituting the words section 133 of the Land Transport Act 1998.

4 New form 10 substituted
  • [Revoked]

    Regulation 4 and the Schedule were revoked, as from 1 February 2000, by regulation 3 Summary Proceedings Amendment Regulations 1999 (SR 1999/360).

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 March 1999, amend forms 5B and 9A in Schedule 1 of the principal regulations and also replace form 10 in the that Schedule in order to incorporate changes to section references and procedures which are necessary as a consequence of the enactment of the Land Transport Act 1998.
