Transport (Breath Tests) Amendment Notice 1999

Pursuant to sections 2 and 218 of the Land Transport Act 1998, the Minister of Police gives the following notice.

Notice

1 Title and commencement
  • (1) This notice may be cited as the Transport (Breath Tests) Amendment Notice 1999, and is part of the Transport (Breath Tests) Notice (No 2) 1989 (SR 1989/389) (the principal notice).

    (2) This notice comes into force on 1 March 1999.

2 Interpretation
  • Clause 2 of the principal notice is amended by revoking the definition of the term enforcement officer, and substituting the following definition:

    enforcement officer means the enforcement officer (within the meaning of section 2 of the Land Transport Act 1998) who is conducting the test.

3 Approval of conclusive evidential breath-testing devices
  • Clause 8 of the principal notice is amended by omitting the words section 58(5) of the Transport Act 1962, and substituting the words section 77(5) of the Land Transport Act 1998.
