  • Preamble

    WHEREAS—

    • B. The next election by beneficiaries of members of the Board should have been held in August 1996, but was held in October 1998, and the things required by the Maori Trust Boards Act 1955 to be done in relation to the election of a Maori Trust Board were not done within the times specified by that Act:

    • C. The Returning Officer appointed for the election should have been appointed by the Minister of Maori Affairs as required by section 52 of the Maori Trust Boards Act 1955:

    • D. The Maniapoto Maori Trust Board Act 1988 also provides—

      • (a) That the membership of the Board must include members elected by Regional Management Committees in accordance with regulations made under section 56 of the Maori Trust Boards Act 1955; and

      • (b) That there must be such number of Regional Management Committees as is specified in those regulations; and

      • (c) That each Regional Management Committee must comprise persons elected in accordance with those regulations to represent the various marae specified in those regulations:

    • E. The regulations required by the Maniapoto Maori Trust Board Act 1988 have not been made under the Maori Trust Boards Act 1955, but the following Regional Management Committees have been established to represent various marae in the Maniapoto area:

      • (a) Hauauru ki Uta Regional Management Committee:

      • (b) Mokau ki Runga Regional Management Committee:

      • (c) Nehenehenui Regional Management Committee:

      • (d) Rereahu Regional Management Committee:

      • (e) Te Tokanganui-a-noho Regional Management Committee:

      • (f) Tuhua/Hikurangi Regional Management Committee:

    • F. The Regional Management Committees have elected members of the Board to replace members whose terms of office expired in August 1996:

NOW THEREFORE, PURSUANT to section 55 of the Maori Trust Boards Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following order.

1 Title and commencement
  • (1) This order may be cited as the Maniapoto Maori Trust Board Order 1999.

    (2) This order comes into force on the day after the date of its notification in the Gazette.

2 Election of members by beneficiaries validated
  • The election by beneficiaries of members of the Maniapoto Maori Trust Board held in October 1998 is declared to be and to have always been valid even though—

    • (a) The election of members should have been held in August 1996, and the things required by the Maori Trust Boards Act 1955 to be done in relation to the election of a Maori Trust Board were not done within the times specified by that Act; and

    • (b) The Returning Officer appointed for the election was not appointed by the Minister of Maori Affairs.

3 Election of members by Regional Management Committees validated
  • The members of the Maniapoto Maori Trust Board elected by Regional Management Committees in or after October 1998 to replace members whose terms of office expired in August 1996 are declared to be and to have always been validly elected even though the regulations required by the Maniapoto Maori Trust Board Act 1988 have not been made under section 56 of the Maori Trust Boards Act 1955 to provide for the election of Regional Management Committees, and to specify the number of Regional Management Committees and the various marae the members of a Regional Management Committee are to represent.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the day after the date of its notification in the Gazette, validates the election of certain members of the Maniapoto Maori Trust Board.

The election of members by beneficiaries held in October 1998 should have been held in August 1996, and the Returning Officer appointed for the election should have been appointed by the Minister of Maori Affairs.

The members elected by Regional Management Committees representing various marae in the Maniapoto area should have been elected under certain regulations required by the Maniapoto Maori Trust Board Act 1988 to be made under the Maori Trust Boards Act 1955. Those regulations have not been made.
