Ozone Layer Protection Amendment Regulations 1999

These regulations are administered in the Ministry for the Environment.


PURSUANT to Part 3 of the Ozone Layer Protection Act 1996, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and on the recommendation of the Minister for the Environment whose recommendation has been made—

  • (a) After consultation by that Minister in accordance with section 17 of that Act; and

  • (b) After being satisfied that, after making the regulations, New Zealand will be able to give effect to its obligations under the Convention and the Protocol,—

makes the following regulations.

1 Title and commencement
  • (1) These regulations may be cited as the Ozone Layer Protection Amendment Regulations 1999, and are part of the Ozone Layer Protection Regulations 19961 (the principal regulations).

    (2) These regulations come into force on the 28th day after the date of their notification in the Gazette.

2 Interpretation
  • Regulation 2 of the principal regulations is amended by inserting, after the definition of the term Methyl chloroform, the following definition:

    Minister means the Minister for Enterprise and Commerce.

3 Prohibition on importation of certain goods containing ozone depleting substances
  • Regulation 19 of the principal regulations is amended by adding the following paragraph:

    • (f) Any dehumidifiers, refrigerators, freezers, air-conditioners, supermarket display cases, heat pumps, and water coolers that contain any CFC (except those that are part of or belong to any other product, equipment, or thing).

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, ban the import of certain products (whether new or second-hand) containing chlorofluorocarbons at the time they are imported. The ban only applies to the itemised products in stand-alone or independent form.

A definition of the term Minister is inserted into the Ozone Layer Protection Regulations 1996 to make it clear that a reference to the Minister in the regulations is a reference to the Minister for Enterprise and Commerce.
