These regulations are administered by the Ministry of Transport.


Pursuant to sections 167 and 168 of the Land Transport Act 1998, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.

Regulations

1 Title and commencement
  • (1) These regulations may be cited as the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999.

    (2) These regulations come into force on 3 May 1999.

2 Interpretation
  • (1) In these regulations, unless the context otherwise requires,—

    the Act means the Land Transport Act 1998

    Driver Licensing rule, means the Land Transport (Driver Licensing) Rule 1999 (Land Transport 91001)

    large passenger service vehicle has the same meaning as it has in section 2(1) of the Land Transport Act 1998

    overseas licence means an overseas driver licence or permit that authorises the holder to drive a class or classes of motor vehicle in New Zealand

    small passenger service vehicle has the same meaning as it has in section 2(1) of the Land Transport Act 1998

    Type D, in relation to an endorsement, means a dangerous goods endorsement

    Type F, in relation to an endorsement, means an endorsement authorising the driving of a special-type vehicle that is a forklift

    Type I, in relation to an endorsement, means a driving instructor endorsement

    Type O, in relation to an endorsement, means a testing officer endorsement

    Type P, in relation to an endorsement, means a passenger endorsement

    Type R, in relation to an endorsement, means an endorsement authorising the driving of a special-type vehicle that runs on rollers

    Type T, in relation to an endorsement, means an endorsement authorising the driving of a special-type vehicle that runs on self-laying tracks

    Type V, in relation to an endorsement, means a vehicle recovery endorsement

    Type W, in relation to an endorsement, means an endorsement authorising the driving of a special-type vehicle that runs on wheels but is not a forklift.

    (2) In these regulations, a reference to a specified class of driver licence is a reference to that class of driver licence as defined in the Driver Licensing rule.

3 Applications to obtain or renew certain driver licences
  • (1) An application for the issue or renewal of a driver licence must be accompanied by—

    • (a) the appropriate application fee or fees specified in Part 1 of the Schedule; and

    • (b) the appropriate fee or fees, if any, specified in Part 4 of the Schedule in respect of the driver test or tests that the applicant will be required to undertake.

    (2) This regulation does not apply to—

    • (a) an application for an endorsement of a driver licence or a renewal of an endorsement:

    • (b) an application for the issue of a limited licence:

    • (c) an application for the issue of a replacement licence in circumstances where regulation 9(1) applies:

    • (d) an application for a New Zealand driver licence by the holder of an overseas driver licence in circumstances where regulation 10 applies.

4 Application for endorsement of driver licences
  • An application for the issue of an endorsement of a driver licence must be accompanied by—

    • (a) the appropriate application fee specified in Part 2 of the Schedule; and

    • (b) the appropriate fee or fees, if any, specified in Part 4 of the Schedule in respect of the driver test or tests that the applicant will be required to undertake; and

    • (c) the appropriate fit and proper person checking fee, if any, described in regulation 6.

5 Applications for renewal of endorsements
  • (1) An application for the renewal of an endorsement of a driver licence must be accompanied by—

    • (a) the appropriate application fee specified in Part 3 of the Schedule; and

    • (b) the appropriate fit and proper person checking fee, if any, described in regulation 6.

    (2) Despite subclause (1)(a), an applicant for the renewal of 2 or more endorsements of Type I, O, P, or V is required to pay 1 application fee in respect of those applications for renewal (being the higher or highest application fee specified in Part 3 of the Schedule for one of those endorsements for which renewal is sought).

6 Other fees payable by applicant for or holder of endorsement
  • (1) An applicant for a Type I, O, P, or V endorsement who does not already hold a Type I, O, P, or V endorsement must pay the appropriate fit and proper person checking fee specified in Part 5 of the Schedule.

    (2) If the holder of a Type P endorsement issued only for the purpose of driving large passenger service vehicles applies for a Type I, O, or V endorsement, or a Type P endorsement to be issued for the purpose of driving small passenger service vehicles or both large and small passenger service vehicles, the applicant must pay the appropriate fit and proper person checking fee specified in Part 5 of the Schedule.

    (3) Despite subclauses (1) and (2), an applicant to whom subclause (1) or subclause (2) applies, who applies for 2 or more endorsements of Type I, O, P, or V, is required to pay 1 fit and proper person checking fee in respect of those applications (being the higher or highest of the applicable fit and proper person checking fees specified in Part 5 of the Schedule for one of those endorsements sought to be issued).

    (4) An applicant for a renewal of a Type I, O, P, or V endorsement must pay the appropriate fit and proper person checking fee specified in Part 5 of the Schedule.

    (5) Despite subclause (4), an applicant for the renewal of 2 or more endorsements of Type I, O, P, or V is required to pay 1 fit and proper person checking fee in respect of those applications for renewal (being the higher or highest of the applicable fit and proper person checking fees specified in Part 5 of the Schedule for one of those endorsements for which renewal is sought).

7 Limited licence fee
  • If an order is made for the issue of a limited licence under section 105 of the Act, the person to whom the licence is issued must pay to the Agency the appropriate fee specified in Part 7 of the Schedule.

8 Fee for driver identification card
  • An application for the issue or renewal of a driver identification card must be accompanied by the appropriate fee specified in Part 7 of the Schedule.

9 Replacement licence or driver identification card
  • (1) An application for a new driver licence to replace a driver licence, where clause 74(2) of the Driver Licensing rule applies, must be accompanied by the appropriate fee specified in Part 7 of the Schedule.

    (2) An application for a new driver identification card to replace a driver identification card, where clause 74(2) of the Driver Licensing rule applies, must be accompanied by the appropriate fee specified in Part 7 of the Schedule.

10 Conversion of overseas licence
  • An application by a holder of an overseas licence for a New Zealand driver licence that would authorise the holder to drive the same class or classes of vehicle as is authorised by the overseas licence, must be accompanied by the fee specified in Part 7 of the Schedule.

11 Course provider approvals
  • An application for approval to run courses approved under the Driver Licensing rule must be accompanied by the appropriate fee specified in Part 8 of the Schedule.

12 Course approval
  • An application for the approval of a course under the Driver Licensing rule must be accompanied by the appropriate fee specified in Part 8 of the Schedule.

13 Information requests
  • An application under section 199(4) or (6) of the Act for information stored in the national register of driver licences must be accompanied by the appropriate fee specified in Part 9 of the Schedule in respect of each person named in the application.

14 Exemptions
  • An application for an exemption from a requirement of the Driving Licensing rule must be accompanied by the fee specified in Part 10 of the Schedule.

15 Refunds
  • (1) An applicant for the issue or renewal of an endorsement of Type I, O, P, or V whose application is declined, and who has paid the fees required to be paid on application, is entitled to the appropriate refund specified in Part 11 of the Schedule (if any), less a deduction to cover the costs of processing the application.

    (1A) Despite subclause (1), an applicant for the issue or renewal of 2 or more endorsements of Type I, O, P, or V—

    • (a) is not entitled to a refund if 1 or more of the applications for issue or renewal are granted:

    • (b) is entitled to the appropriate refund specified in Part 11 of the Schedule in respect of the 1 application fee paid by the applicant, less a deduction to cover the cost of processing the applications, if all the applications for issue or renewal are declined.

    (2) An applicant for the issue or renewal of an endorsement of Type I, O, P, or V whose application is declined, and who has paid a fit and proper person checking fee, is entitled to a refund of the proportion of the fit and proper person checking fee that relates to vetting yet to be undertaken, less a deduction to cover the costs of processing the application.

    (3) An applicant for a driver licence (including an endorsement of a licence) who gives at least 2 days' notice of the applicant's intention to withdraw from a driver test required for the issue of the licence, and who has paid the prescribed fee for the test, is entitled to a refund of the prescribed fee for the test, less a deduction to recover the costs of arranging the test.

    (4) The Agency may waive a fee prescribed or assessed under these regulations, provide for a rebate of that fee, or, if all or any part of the fee has been paid, refund to the person who paid it the amount already paid, if the Agency is satisfied that there are special circumstances applicable to the particular case.

15A Refund on conversion of endorsement
  • (1) Subclause (2) applies to a person who was issued with an endorsement of Type I, O, P, or V before 4 October 1999, and who applies on or after that date, while that endorsement is still in force or after having voluntarily surrendered that endorsement, for a new endorsement of the same type as was issued to the person before 4 October 1999 (being an endorsement of Type I, O, P, or V).

    (2) If this subclause applies, a person who applies for an endorsement to be issued for a period of 1 year is entitled to a refund in respect of any relevant monthly fees paid for the endorsement issued before 4 October 1999 that the new endorsement is to replace.

    (3) The refund referred to in subclause (2) is the product of the number of months from the date of application for a refund until the expiry date specified in the endorsement issued before 4 October 1999 and the relevant monthly fee for that type of endorsement, less a deduction to cover the costs of processing the application for a refund.

    (4) For the purposes of this regulation, the relevant monthly fee for a type of endorsement is the appropriate fee specified in Part 6 of the Schedule of the principal regulations, immediately before its revocation by these regulations.

    (5) Subclause (2) does not apply if the relevant monthly fees referred to in that subclause—

    • (a) have not been paid; or

15B Transitional refunds
  • (1) A person who was issued with 2 or more endorsements of Type I, O, P, or V by or on behalf of the Director under the Driver Licensing rule before 4 October 1999, and is the holder of those endorsements is entitled, if the person paid the appropriate fees in Parts 2, 5, and 6 of the Schedule of the principal regulations (as specified immediately before their amendment or revocation by these regulations), to a refund in respect of those fees, in accordance with this regulation.

    (2) The refund referred to in subclause (1) is the total amount of the fees specified in Parts 2, 5, and 6 of the Schedule of the principal regulations that was paid in respect of all the applications by the person for 2 or more endorsements of Type I, O, P, or V, less the amounts referred to in subclause (3).

    (3) The amounts to be deducted from the refund referred to in subclause (2) are—

    • (a) the higher or highest of the total amounts payable under Parts 2, 5, and 6 of the Schedule of the principal regulations in respect of each endorsement of Type I, O, P, or V that was applied for; and

    • (b) a deduction to cover the costs of processing the application for a refund.

    (4) A person who holds an endorsement of Type P on 4 October 1999, and on or after that date provides an undertaking to a licensing agent in a form approved by that agent that the person will use that endorsement only for the purpose of driving large passenger service vehicles, is entitled, if the person paid the fee in Part 5 of the Schedule of the principal regulations (as specified immediately before that Part was amended by these regulations), to a refund of $112.80.

16 Fees inclusive of GST
  • The fees prescribed by or assessed under these regulations are inclusive of goods and services tax.

17 Payment for medical examination
  • The fee to be paid by a person required to undertake a medical examination under the Driver Licensing rule is a reasonable fee fixed by the person who undertakes the examination.

1 General
  • This is a reprint of the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999. The reprint incorporates all the amendments to the regulations as at 1 August 2008, as specified in the list of amendments at the end of these notes.

    Relevant provisions of any amending enactments that have yet to come into force or that contain relevant transitional or savings provisions are also included, after the principal enactment, in chronological order.

2 Status of reprints
  • Under section 16D of the Acts and Regulations Publication Act 1989, reprints are presumed to correctly state, as at the date of the reprint, the law enacted by the principal enactment and by the amendments to that enactment. This presumption applies even though editorial changes authorised by section 17C of the Acts and Regulations Publication Act 1989 have been made in the reprint.

    This presumption may be rebutted by producing the official volumes of statutes or statutory regulations in which the principal enactment and its amendments are contained.

3 How reprints are prepared
  • A number of editorial conventions are followed in the preparation of reprints. For example, the enacting words are not included in Acts, and provisions that are repealed or revoked are omitted. 4 Changes made under section 17C of the Acts and Regulations Publication Act 1989
  • Section 17C of the Acts and Regulations Publication Act 1989 authorises the making of editorial changes in a reprint as set out in sections 17D and 17E of that Act so that, to the extent permitted, the format and style of the reprinted enactment is consistent with current legislative drafting practice. Changes that would alter the effect of the legislation are not permitted.

    A new format of legislation was introduced on 1 January 2000. Changes to legislative drafting style have also been made since 1997, and are ongoing. To the extent permitted by section 17C of the Acts and Regulations Publication Act 1989, all legislation reprinted after 1 January 2000 is in the new format for legislation and reflects current drafting practice at the time of the reprint.

    In outline, the editorial changes made in reprints under the authority of section 17C of the Acts and Regulations Publication Act 1989 are set out below, and they have been applied, where relevant, in the preparation of this reprint:

    • omission of unnecessary referential words (such as of this section and of this Act)

    • typeface and type size (Times Roman, generally in 11.5 point)

    • layout of provisions, including:

      • indentation

      • position of section headings (eg, the number and heading now appear above the section)

    • format of definitions (eg, the defined term now appears in bold type, without quotation marks)

    • format of dates (eg, a date formerly expressed as the 1st day of January 1999 is now expressed as 1 January 1999)

    • position of the date of assent (it now appears on the front page of each Act)

    • punctuation (eg, colons are not used after definitions)

    • Parts numbered with roman numerals are replaced with arabic numerals, and all cross-references are changed accordingly

    • case and appearance of letters and words, including:

      • format of headings (eg, headings where each word formerly appeared with an initial capital letter followed by small capital letters are amended so that the heading appears in bold, with only the first word (and any proper nouns) appearing with an initial capital letter)

      • small capital letters in section and subsection references are now capital letters

    • schedules are renumbered (eg, Schedule 1 replaces First Schedule), and all cross-references are changed accordingly

    • running heads (the information that appears at the top of each page)

    • format of two-column schedules of consequential amendments, and schedules of repeals (eg, they are rearranged into alphabetical order, rather than chronological).
