Pursuant to section 3 of the Machinery Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following order.

Order

1 Title and commencement

(1)

This order may be cited as the Machinery (Exclusion of Some Pressure Equipment, Cranes, and Passenger Ropeways) Order 1999.

(2)

This order comes into force on the 28th day after the date of its notification in the Gazette.

2 Interpretation

In this order,—

equipment means equipment within the meaning of the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999 that is used, or is intended to be used, in a place of work

place of work means a place of work within the meaning of the Health and Safety in Employment Act 1992.

3 Equipment excluded from Machinery Act 1950

This order declares that equipment is not subject to the provisions of the Machinery Act 1950.

Explanatory Note

This note is not part of the order, but is intended to indicate its general effect.

This order excludes from the coverage of the Machinery Act 1950 pressure equipment, cranes, and passenger ropeways, and related items, used or intended to be used in a place of work. The Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999 deal with matters relating to their safety.
