PURSUANT to section 4 of the Local Government (Millennium Events) Amendment Act 1999, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Local Government, makes the following order.

1 Title and commencement
  • (1) This order may be cited as the Local Government (Tauranga District Council Millennium Events) Order 1999.

    (2) This order comes into force on the 28th day after the date of its notification in the Gazette.

2 Tauranga District Council proposed district plan amended
  • The Tauranga District Council's proposed district plan is amended in the manner indicated in the Schedule.

  • Rule 22.2.1.8 is amended by adding the following paragraphs:

    • (f) Paragraphs (a) and (d) of Rule 22.2.1.8 do not apply for the periods between 1300 hours and 1630 hours on 31 December 1999 and between 2000 hours on 31 December 1999 and 0530 hours on 1 January 2000 in relation to the Millennium Concert on Mount Drury (Hopukiore) Reserve in the area adjoining Marine Parade (as shown on Plan reference Tauranga District Council's New Year's Eve Concert 1999/2000 dated October 1999) but the noise limit of the Millennium Concert must not exceed 80dBA at any point within the boundary of any Residential Zone.

    • (g) Paragraphs (a) and (d) of Rule 22.2.1.8 do not apply for the periods between 2000 hours on 31 December 1999 and 0700 hours on 1 January 2000 in relation to the fireworks display on Moturiki Island on 31 December 1999 and 1 January 2000.

  • Table 7 of Rule 24.1 is amended by adding, under the column heading Activity, the following:

    The assembly of people on Marine Parade between Pacific Avenue and Grace Avenue between 0700 hours on 31 December 1999 and 0700 hours on 1 January 2000.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force 28 days after its notification in the Gazette, amends the Tauranga District Council proposed district plan. The amendments are required so that certain rules in the Tauranga District Council proposed district plan are not breached as a result of the holding of a free public concert and a pre-dawn fireworks display on New Years Eve 1999/2000.
