Freshwater Fish Farming Amendment Regulations (No 2) 2000


Note

These regulations are administered in the Ministry of Fisheries.


Pursuant to sections 89 and 91 of the Fisheries Act 1983 and sections 297 and 301 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • (1) These regulations are the Freshwater Fish Farming Amendment Regulations (No 2) 2000.

    (2) In these regulations, the Freshwater Fish Farming Regulations 19831 are called the principal regulations.

2 Commencement
  • These regulations come into force on 1 October 2000.

3 Fees
  • (1) Regulation 15A of the principal regulations is amended by inserting, after subclause (1), the following subclause:

    • (1A) If the cost of processing an application (in respect of which a fee is prescribed in the Schedule) at the rate of $202.62 per hour or part of an hour—

      • (a) is less than the prescribed fee, the chief executive must remit the balance of the prescribed fee:

      • (b) is more than the prescribed fee, the applicant must pay the additional amount.

    (2) Regulation 15A of the principal regulations is amended by revoking subclause (3).

4 New Schedule substituted
  • The principal regulations are amended by revoking the Schedule, and substituting the Schedule set out in the Schedule of these regulations.

5 Revocations
  • The following regulations are consequentially revoked:

    • (a) Freshwater Fish Farming Amendment Regulations 1997 (SR 1997/191):

    • (b) Freshwater Fish Farming Amendment Regulations 1998 (SR 1998/280).

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 October 2000, amend the Freshwater Fish Farming Regulations 1983.

The amendments—

  • (a) increase the fees payable for applications in respect of fish-farm licences and approvals; and

  • (b) require the remission of part of the fees payable for those applications or the payment of additional amounts, based on the time taken to process the applications at a specified hourly rate.
