Fisheries Act Commencement Order 2000


Note

This order is administered in the Ministry of Fisheries.


Pursuant to section 1(2) of the Fisheries Act 1996, section 1(4) of the Fisheries Act 1996 Amendment Act 1999, and section 1(3) of the Fisheries Act 1996 Amendment Act (No 2)1999, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force on various dates certain provisions of the Fisheries Act 1996, the Fisheries Act 1996 Amendment Act 1999, and the Fisheries Act 1996 Amendment Act (No 2) 1999. The provisions concerned and their respective commencement dates are as follows:

Fisheries Act 1996

  • section 67B (which relates to stocks that do not have an underfishing right) commences 1 October 2000:

  • Part 12 (which relates to the observer programme) commences 1 October 2000:

  • section 228 (which relates to breaches of conditions or requirements under the Act) commences 1 October 2000:

  • section 314(1)(w) (which repeals provisions of the Fisheries Act 1983 relating to scientific observers) commences 1 October 2000:

  • section 331(4) (which is a savings provision relating to the observer programme) commences 1 October 2000:

  • section 341 (which relates to the confirmation of quota under the Act) commences 1 October 2000:

  • Schedule 4 (which relates to stocks for which provisional catch history is not prorated) commences 1 October 2000:

Fisheries Act 1996 Amendment Act 1999

  • section 24 (only for the purpose of bringing into force section 67B of the Fisheries Act 1996, which is inserted by section 24) commences 1 October 2000:

  • section 51 (which amends section 228 of the Fisheries Act 1996) commences 1 October 2000:

  • section 63 (which substitutes new cost recovery provisions in the Fisheries Act 1996) commences 1 February 2001:

  • section 91 (which is a transitional provision relating to section 63) commences 1 February 2001:

Fisheries Act 1996 Amendment Act (No 2) 1999

  • section 2 (which inserts new definitions into the Fisheries Act 1996) commences 1 October 2000:

  • section 3 (which amends section 52 of the Fisheries Act 1996 and relates to the alteration of provisional catch history) commences 29 September 2000:

  • section 4 (which amends section 53 of the Fisheries Act 1996 and relates to the calculation of entitlement to quota following an appeal to the Catch History Review Committee) commences 29 September 2000:

  • section 5 (which amends section 55 of the Fisheries Act 1996 and relates to the protection of quota allocated to the Treaty of Waitangi Fisheries Commission) commences 1 October 2000:

  • section 32 (which is a consequential amendment to a transitional provision relating to the allocation of quota) commences 29 September 2000:

  • section 33 (which is also a consequential amendment to a transitional provision relating to the allocation of quota) commences 29 September 2000.
