Pursuant to section 291(2)(c) of the Accident Insurance Act 1998, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title
  • This order is the Accident Insurance (Motor Spirits Duty) Order 2001.

2 Commencement
  • This order comes into force on the day after the date of its notification in the Gazette.

3 Rate for calculation of funding amount
  • For the purposes of calculating the amount to be paid under section 291(2)(c) of the Accident Insurance Act 1998 for every litre of motor spirits in respect of which duty is payable under the Customs and Excise Act 1996,—

    • (a) the rate is 3 cents per litre for amounts payable in respect of the period from the commencement of this order until the close of 30 June 2001; and

    • (b) the rate is 2.3 cents per litre for amounts payable in respect of the year commencing on 1 July 2001 and subsequent years.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the day after the date of its notification in the Gazette, is made under section 291(2)(c) of the Accident Insurance Act 1998, which specifies the rate of contribution to be made to the Motor Vehicle Account from the duty payable on motor spirits under the Customs and Excise Act 1996.

The current rate of 2 cents per litre is changed to—

  • (a) 3 cents per litre in respect of the period from the commencement of the order until 30 June 2001; and

  • (b) 2.3 cents per litre on and after 1 July 2001.
