Fisheries (South-East Area Amateur Fishing) Amendment Regulations 2001

These regulations are administered in the Ministry of Fisheries.


Pursuant to section 89 of the Fisheries Act 1983 and sections 297 and 298 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on the day after the date of their notification in the Gazette.

3 New regulation 4A inserted
  • The principal regulations are amended by inserting, after regulation 4, the following regulation:

    4A Set netting prohibited in Canterbury set net area
    • (1) No person may use or set any set net within the Canterbury set net area during the period that begins on the date of commencement of the Fisheries (South-East Area Amateur Fishing) Amendment Regulations 2001 and ends with the close of 30 September 2001.

      (2) In this regulation, Canterbury set net area means—

      • (a) all fisheries waters on the east of the South Island lying within an area defined by a line commencing at a point north of the Waiau River at 42° 45'S and 173° 23.50'E; then proceeding east to the edge of the territorial sea at 173° 41.10'E; then proceeding south along the outer boundary of the territorial sea to the 45th parallel at 171° 25.0'E; then proceeding west to the land boundary of the 45th parallel south of the Waitaki River at 171° 06.30'E; but

      • (b) does not include Lake Ellesmere (being the quota management area ANG13—Ellesmere described in Part III of the First Schedule of the Fisheries Act 1996) or any river or stream that flows into Lake Ellesmere or any tributary of any river or stream that flows into Lake Ellesmere.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the day after the date of their notification in the Gazette, amend the Fisheries (South-East Area Amateur Fishing) Regulations 1986. They prohibit amateur fishers from using or setting any set net within the area defined as the Canterbury set net area during the period between the commencement of the regulations and 30 September 2001. This area does not include Lake Ellesmere, any river or stream that flows into Lake Ellesmere, or any tributary of any river or stream that flows into Lake Ellesmere (that is, it does not include the quota management area ANG13—Ellesmere). The aim of the prohibition is to protect Hector's dolphins.
