Disputes Tribunals Amendment Rules 2001


Note

These rules are administered in the Department for Courts.


Pursuant to section 60 of the Disputes Tribunals Act 1988, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following rules.

1 Title
  • (1) These rules are the Disputes Tribunals Amendment Rules 2001.

    (2) In these rules, the Disputes Tribunals Rules 19891 are called the principal rules.

2 Commencement
  • These rules come into force on 15 October 2001.

    Rule 2 was amended, as from 29 June 2001, by rule 3 Disputes Tribunals Amendment Rules (No 2) 2001 (SR 2001/164) by substituting the expression 1 October for the expression 1 July.

    Rule 2 was further amended, as from 28 September 2001, by rule 3 Disputes Tribunals Amendment Rules (No 3) 2001 (SR 2001/288) by substituting the expression 15 October for the expression 1 October.

3 Fees
  • Rule 5 of the principal rules is amended by revoking subclause (1), and substituting the following subclause:

    • (1) The following fee is payable to the Tribunal at the time of the lodging of a claim:

      • (a) $30, if the total amount in respect of which an order of a Tribunal is sought under the claim is less than $1,000:

      • (b) $50, if the total amount in respect of which an order of a Tribunal is sought under the claim is $1,000 or more but less than $5,000:

      • (c) $100, if the total amount in respect of which an order of a Tribunal is sought under the claim is $5,000 or more.

Explanatory note

This note is not part of the rules, but is intended to indicate their general effect.

These rules, which come into force on 1 July 2001, substitute the following fees payable in respect of claims lodged with a Disputes Tribunal:

  • the fee for lodging a claim where the total amount in respect of which an order of a Tribunal is sought is less than $1,000 is $30:

  • the fee for lodging a claim where the total amount in respect of which an order of a Tribunal is sought is $1,000 or more but less than $5,000 is $50:

  • the fee for lodging a claim where the total amount in respect of which an order of a Tribunal is sought is $5,000 or more is $100.

The fees include goods and services tax.
