United Nations Sanctions (Afghanistan) Amendment Regulations 2001

These regulations are administered in the Ministry of Foreign Affairs and Trade.


Pursuant to section 2 of the United Nations Act 1946, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on 1 December 2001.

3 Interpretation
  • (1) Regulation 3(1) of the principal regulations is amended by revoking the definition of the term money, and substituting the following definition:

    entity means a person, group, trust, partnership, or fund, or an unincorporated association or organisation.

    (2) Regulation 3(1) of the principal regulations is amended by revoking the definition of the term security.

    (3) Regulation 3(1) of the principal regulations is amended by revoking the definition of the term Taliban entity, and substituting the following definition:

    Taliban entity means an entity (other than the Taliban) designated, by or under 1 or more resolutions of the Security Council relating to Afghanistan, as an entity against whom a sanction imposed by those resolutions and provided for in regulation 17 is to be imposed.

    (4) Regulation 3 of the principal regulations is amended by revoking subclause (2).

    (5) Regulation 3(3) of the principal regulations is amended by omitting the words in the Gazette, and substituting the words , in any manner the Minister thinks fit (for example, by notice in the Gazette, or publication on the Internet, or both),.

    (6) Regulation 3(3) of the principal regulations is further amended by revoking paragraph (a), and substituting the following paragraph:

    • (a) a list of the names of any entities who, in accordance with 1 or more resolutions of the Security Council relating to Afghanistan and imposing sanctions, are for the time being designated as Taliban entities in relation to a sanction provided for in regulation 17:.

4 Heading and regulations 15 and 16 revoked
  • The principal regulations are amended by revoking the heading above regulation 15, and regulations 15 and 16.

5 New regulation 20A inserted
  • The principal regulations are amended by inserting, after regulation 20, the following regulation:

    20A United Nations Sanctions (Terrorism Suppression and Afghanistan Measures) Regulations 2001 not affected
    • Nothing in these regulations affects the United Nations Sanctions (Terrorism Suppression and Afghanistan Measures) Regulations 2001.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 December 2001, amend the United Nations Sanctions (Afghanistan) Regulations 2001. The main change is the revocation of regulations 15 and 16. The sanctions that those regulations provided for are to be implemented instead through the United Nations Sanctions (Terrorism Suppression and Afghanistan Measures) Regulations 2001. Those regulations, which also come into force on that date, do not affect in any other way the United Nations Sanctions (Afghanistan) Regulations 2001.
