Pursuant to sections 13 and 25(1) of the Health and Disability Services (Safety) Act 2001, the Minister of Health gives the following notice.

1 Title
  • This notice is the Health and Disability Services (Safety) Hospital Care, Residential Disability Care, and Rest Home Care Standards Notice 2002.

2 Commencement
  • This notice comes into force on 1 July 2002.

3 Standards for providing hospital care, residential disability care, and rest home care approved
  • (1) The following standards are approved for providing hospital care, residential disability care, and rest home care:

    • (a) Infection Control, NZS 8142:2000:

    • (b) Restraint Minimization and Safe Practice, NZS 8141:2001:

    • (c) Health and Disability Sector Standards, NZS 8134:2001.

    (2) National Mental Health Sector Standard, NZS 8143:2001, is approved for providing mental health services.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice approves standards for providing hospital care, residential disability care, and rest home care.

It also approves standards for providing mental health services; but section 25(2) of the Health and Disability Services (Safety) Act 2001 (the principal Act) provides that, until the application of the principal Act is extended to all mental health services, standards approved for providing mental health services apply only to mental health services provided as part of hospital care, residential disability care, or rest home care.

The notice comes into force on 1 July 2002, which is the day on which the provisions of the principal Act relating to the certification of providers of hospital care, residential disability care, and rest home care, and the designation of agencies to audit those providers, come into force.

On 1 October 2002, there will come into force provisions of the principal Act that impose requirements to be certified under the principal Act and comply with the standards on providers of hospital care, residential disability care, and rest home care (other than providers licensed under existing legislation, who have a transitional period of 2 years before the requirements apply to them).
