Heavy Motor Vehicle Amendment Regulations 2002


Note

These regulations are administered in the Ministry of Transport.


Pursuant to sections 167 and 218 of the Land Transport Act 1998, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • (1) These regulations are the Heavy Motor Vehicle Amendment Regulations 2002.

    (2) In these regulations, the Heavy Motor Vehicle Regulations 19741 are called the principal regulations.

2 Commencement
  • These regulations come into force on 1 July 2002.

3 Use of roads and general weight limitations
  • Regulation 5 of the principal regulations is amended by revoking subclauses (1) to (4), and substituting the following subclause:

    • (1) A person may not operate a motor vehicle if the weight of the vehicle on its axles exceeds the weight prescribed for its axles by section 4.3 or section 4.4 or section 4.5 of Land Transport Rule: Vehicle Dimensions and Mass 2002.

4 Permits to exceed weight limits
  • Regulation 7(1A) of the principal regulations is amended by inserting, after the words this regulation, the words , or by a road controlling authority under section 5 of Land Transport Rule: Vehicle Dimensions and Mass 2002,.

5 Road construction zones
  • Regulation 12(4) of the principal regulations is amended by omitting the words regulations 5, 6, and, and substituting the words Land Transport Rule: Vehicle Dimensions and Mass 2002, and regulation.

6 Revocations and savings
  • (1) The principal regulations are amended by revoking—

    • (b) forms B and C of Schedule 1; and

    • (c) Schedule 2; and

    • (d) Schedule 3.

    (2) Despite subclause (1)(a),—

    • (a) permits issued under regulations 6 and 7(1) and (1B) to (8) of the principal regulations before the commencement of these regulations continue to have effect as if regulations 6 and 7(1) and (1B) to (8) of the principal regulations had not been revoked; and

    • (b) the penalties for offences in respect of those permits continue to apply as if regulations 6 and 7(1) and (1B) to (8) of the principal regulations had not been revoked.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 July 2002, amend the Heavy Motor Vehicle Regulations 1974. The amendments accommodate the making of Land Transport Rule: Vehicle Dimensions and Mass 2002 (41001). These regulations are a companion to the Traffic Amendment Regulations 2002 and the Land Transport (Offences and Penalties) Amendment Regulations (No 2) 2002.
