Traffic Amendment Regulations 2002


Note

These regulations are administered in the Ministry of Transport.


Pursuant to sections 167 and 218 of the Land Transport Act 1998, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • (1) These regulations are the Traffic Amendment Regulations 2002.

    (2) In these regulations, the Traffic Regulations 19761 are called the principal regulations.

2 Commencement
  • These regulations come into force on 1 July 2002.

3 Interpretation
  • Regulation 2 of the principal regulations is amended by inserting, after the definition of stop lamp or brake lamp, the following definition:

    temporary-use spare tyre has the same meaning as in Part 2 of Land Transport Rule: Tyres and Wheels (2001).

4 Speed limits
  • Regulation 21 of the principal regulations is amended by inserting, after subclause (7), the following subclause:

    • (7A) A person may not drive a motor vehicle fitted with a temporary-use spare tyre on any road—

      • (a) at a speed exceeding 80 kilometres per hour; or

      • (b) at a speed exceeding the maximum speed specified by the tyre manufacturer, if that speed is less than 80 kilometres per hour.

5 Revocations and savings
  • (1) The principal regulations are amended by revoking—

    (2) Despite subclause (1)(c),—

    • (a) approvals given under regulation 49 of the principal regulations before the commencement of these regulations continue to have effect until 1 October 2002 for approved overdimension vehicles and loads that do not comply with Land Transport Rule: Vehicle Dimensions and Mass (2002) as if regulation 49 of the principal regulations had not been revoked; and

    • (b) the penalties for offences in respect of those approvals continue to apply as if regulation 49 of the principal regulations had not been revoked.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 July 2002, amend the Traffic Regulations 1976. The amendments accommodate the making of Land Transport Rule: Vehicle Dimensions and Mass 2002 (41001). They also create speed limits for driving a motor vehicle fitted with a temporary-use spare tyre to ensure the application of the offence provisions in the Traffic Regulations 1976 and the infringement fee scale in Part 2 of Schedule 2 of the Transport Act 1962 to a breach of section 2.6(8) of Land Transport Rule: Tyres and Wheels 2001 (32013). These regulations are a companion to the Land Transport (Offences and Penalties) Amendment Regulations (No 2) 2002 and the Heavy Motor Vehicle Amendment Regulations 2002.
