Pursuant to section 68(1) of the Medical Practitioners Act 1995, the Minister of Health gives the following notice.

1 Title
  • This notice is the Medical Practitioners (Quality Assurance Activity: Obstetricians and Gynaecologists: New Zealand Committee Practice Visits) Notice 2002.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of quality assurance activity
  • The quality assurance activity called the Royal Australian and New Zealand College of Obstetricians and Gynaecologists: New Zealand Committee Practice Visits Quality Assurance Activity and described in the Schedule is a quality assurance activity to which Part 6 of the Medical Practitioners Act 1995 applies.

Description of Royal Australian and New Zealand College of Obstetricians and Gynaecologists: New Zealand Committee Practice Visits Quality Assurance Activity

1 Interpretation
  • In this schedule,—

    activity means the Royal Australian and New Zealand College of Obstetricians and Gynaecologists: New Zealand Committee Practice Visits Quality Assurance Activity

    College means the Royal Australian and New Zealand College of Obstetricians and Gynaecologists

    Committee means the New Zealand Committee of the College

    Subcommittee means the Committee's Practice Improvement and Audit Subcommittee.

2 Sponsor
  • The activity is carried out under the auspices of the Committee.

3 Method
  • (1) The activity is based on information—

    • (a) derived from medical practitioners who are Fellows of the College; and

    • (b) about the practice and competence of those medical practitioners; and

    • (c) acquired before or during practice visits.

    (2) The activity involves—

    • (a) each medical practitioner who is engaging in the activity being visited, at least once every 3 years, by 2 independent Fellows of the College appointed by the Committee for that purpose:

    • (b) in the course of each visit, an assessment and evaluation of the practice and competence of the medical practitioner with the aid of information gathered from—

      • (i) a practice profile questionnaire completed before the visit by the medical practitioner:

      • (ii) a survey of patient satisfaction completed before the visit by 50 patients selected at random:

      • (iii) results taken from a surgical database:

      • (iv) interviews with the managers of the delivery suite and of the operating theatre in which the medical practitioner most frequently undertakes deliveries or performs surgery, as the case may be:

      • (v) observation for approximately 2 hours of the medical practitioner operating in an operating theatre:

    • (c) a report on the visit to the Subcommittee:

    • (d) an assessment by the Subcommittee of the information obtained as a result of the visit:

    • (e) the making of recommendations by the Subcommittee on how the medical practitioners who are engaging in the activity can improve their performance so as to—

      • (i) improve the quality of the care they provide; and

      • (ii) reduce the incidence of adverse outcomes:

    • (f) the facilitation and monitoring of the implementation of any such recommendations.

4 Objective
  • The objective of the activity is to improve the quality of care provided by medical practitioners engaged in the activity.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice declares that the quality assurance activity called the Royal Australian and New Zealand College of Obstetricians and Gynaecologists: New Zealand Committee Practice Visits Quality Assurance Activity is a quality assurance activity to which Part 6 of the Medical Practitioners Act 1995 applies. Obstetricians and gynaecologists who are Fellows of the College will participate in the activity.

The effect of this declaration is that, subject to certain exceptions,—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the persons who engage in the activity in good faith are immune from civil liability.

Under section 69 of the Medical Practitioners Act 1995, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
