Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on 11 July 2002.

3 Person and vessel limits on number of rock lobster pots in Bay of Plenty area
  • (1) Regulation 3D(1) of the principal regulations is amended by revoking paragraph (a), and substituting the following paragraph:

    • (a) in the case of pots being used, set, or possessed by an individual in those waters (including by an individual who is the only person on a vessel), 3 pots:

    (2) Regulation 3D(2) of the principal regulations is amended by inserting, after the word person where it second occurs, the words (being an individual to whom subclause (1)(a) applies).

    (3) Regulation 3(D(3) of the principal regulations is amended by inserting, after the word person where it second occurs, the words (being a person to whom subclause (1)(b) applies).

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 11 July 2002, amend the Fisheries (Auckland and Kermadec Areas Amateur Fishing) Regulations 1986 to make it clear that the individual rock lobster pot limit of 3 (and not the vessel pot limit of 6) applies to pots used, set, or possessed by a lone individual from a vessel.
