This order is administered in the Ministry of Fisheries.
Pursuant to section 1(2) of the Fisheries Act 1996, section 1(4) of the Fisheries Act 1996 Amendment Act 1999, and section 1(3) of the Fisheries Act 1996 Amendment Act (No 2) 1999, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.
2 Commencement of balance of section 314(1)(e) of Fisheries Act 1996 (in relation to controlled fisheries)
This order is the Fisheries Act Commencement Order 2002.
Section 314(1)(e) of the Fisheries Act 1996, so far as it was not brought into force by clause 2(4) of the Fisheries Act Commencement Order (No 2) 2001 (SR 2001/179), comes into force on 11 July 2002.

This note is not part of the order, but is intended to indicate its general effect.
Clause 2(4) of the Fisheries Act Commencement Order (No 2) 2001 brought section 314(1)(e) of the Fisheries Act 1996 into force on 1 October 2001, except insofar as it repealed provisions of the Fisheries Act 1983 that related to controlled fisheries.
Coromandel scallops were the last controlled fishery in existence under the 1983 Act, and they have now been brought under the quota management system by the Fisheries (Declaration of New Stock Subject to Quota Management System) Notice 2001, with effect from 1 April 2002.
This order therefore brings into force the balance of section 314(1)(e) of the 1996 Act, so that all remaining provisions of the 1983 Act relating to controlled fisheries are repealed with effect on and after 11 July 2002.
