Sentencing Act Commencement Order 2002


This order is administered in the Department of Corrections.

Pursuant to section 2 of the Sentencing Act 2002, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force, on 30 June 2002, the Sentencing Act 2002.

The Act replaces many provisions of the Criminal Justice Act 1985. The purposes of the Act are—

  • to set out the purposes for which offenders may be sentenced or otherwise dealt with; and

  • to promote those purposes, and aid in the public's understanding of sentencing practices, by providing principles and guidelines to be applied by courts in sentencing or otherwise dealing with offenders; and

  • to provide a sufficient range of sentences and other means of dealing with offenders; and

  • to provide for the interests of victims of crime.
