Domestic Violence Amendment Rules (No 2) 2002


Note

These rules are administered in the Ministry of Justice.


Pursuant to section 126 of the Domestic Violence Act 1995, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following rules.

1 Title
  • (1) These rules are the Domestic Violence Amendment Rules (No 2) 2002.

    (2) In these rules, the Domestic Violence Rules 19961 are called the principal rules.

2 Commencement
  • These rules come into force on 21 October 2002.

3 Application
  • Rule 2(2) of the principal rules is amended by inserting, after paragraph (a), the following paragraph:

    • (aa) proceedings under the Act to which the Family Courts Rules 2002 apply, namely—

      • (i) proceedings in a Family Court; and

      • (ii) proceedings in a District Court acting under section 15 of the Family Courts Act 1980; or.

4 Procedure on transfer of proceedings
  • Rule 81(3) of the principal rules is revoked.

5 Registration of foreign protection orders
  • Rule 91(a) of the principal rules is amended by omitting the words the Family Court which is a division of.
