Fisheries (South-East Area Commercial Fishing) Amendment Regulations 2002

These regulations are administered in the Ministry of Fisheries.


Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on 1 October 2002.

3 New regulation 2C inserted
  • The principal regulations are amended by inserting, after regulation 2B, the following regulation:

    2C Minimum net mesh for queen scallop trawling
    • (1) A commercial fisher must not use or possess a trawl net for taking queen scallop in the South-East Fishery Management Area with net mesh less than 50 mm.

      (2) Regulation 4 of the Fisheries (Commercial Fishing) Regulations 2001 ensures that subclause (1) overrides regulation 71 of those regulations.

4 Shellfish dredges
  • Regulation 10AA of the principal regulations is amended by omitting the word fisherman, and substituting the word fisher.

5 Regulation 11C revoked
  • Regulation 11C of the principal regulations is revoked.

6 Queen scallop season and quotas
  • Regulation 11H(1) of the principal regulations is revoked.

7 Regulations 11I and 11JA revoked
  • Regulations 11I and 11JA of the principal regulations are revoked.

8 Restrictions on fishing methods
  • Regulation 11K(2) of the principal regulations is amended by omitting the words paddle crab,.

9 Offences
  • Regulation 12(2) of the principal regulations is amended—

    • (a) by inserting, after the expression 2B,, the expression 2C, ; and

    • (b) by omitting the expression 11C, ; and

    • (c) by omitting the words 11H to 11JA, and substituting the words 11H(2) and (3), 11J.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations which come into force on 1 October 2002, amend the Fisheries (South-East Area Commercial Fishing) Regulations 2002. The amendments are needed to accommodate the inclusion of various species in the quota management system.

Regulation 3 inserts new regulation 2C, which prohibits commercial trawling for queen scallops with a net mesh less than 50 mm.

Regulation 4 is a minor correction.

Regulation 5 revokes the commercial catch limit for kina.

Regulation 6 revokes the commercial catch limit for queen scallop.

Regulation 7 revokes the commercial catch limit for paddle crab and butterfish.

Regulation 8 removes a fishing method restriction for paddle crab.

Regulation 9 adjusts the offences to reflect the earlier changes.
