Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Amendment Regulations (No 2) 2002

These regulations are administered in the Ministry of Fisheries.


Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on 1 October 2002.

3 New regulation 3BA inserted
  • The principal regulations are amended by inserting, after regulation 3B, the following regulation:

    3BA Minimum net mesh for queen scallop trawling
    • (1) A commercial fisher must not use or possess a trawl net for taking queen scallop in the Southland and Sub-Antarctic Fishery Management Area with net mesh less than 50 mm.

      (2) Regulation 4 of the Fisheries (Commercial Fishing) Regulations 2001 ensures that subclause (1) overrides regulation 71 of those regulations.

4 Regulation 15D revoked
  • Regulation 15D of the principal regulations is revoked.

5 Kina season and quotas
  • Regulation 15F(1) of the principal regulations is revoked.

6 Regulation 15G revoked
  • Regulation 15G of the principal regulations is revoked.

7 Restrictions on fishing methods
  • Regulation 15I(2) of the principal regulations is amended by revoking the words paddle crab,.

8 Offences
  • Regulation 16(2) of the principal regulations is amended—

    • (a) by omitting the words 3 to 3B, 3D to 4B,, and substituting the words 3 to 3BA, 3D, 3E, 4 to 4B, ; and

    • (b) by omitting the words 15F to 15HA, and substituting the words 15F(2) and (3), 15H, 15HA.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which amend the Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Amendment Regulations 2002, come into force on 1 October 2002. The amendments are needed to accommodate the inclusion of various species in the quota management system.

Regulation 3 inserts new regulation 3BA that prohibits commercial trawling for queen scallops with a net mesh less than 50 mm.

Regulations 4, 5, and 6 remove the commercial catch limits for butterfish, kina, and paddle crab.

Regulation 7 removes a fishing method restriction for paddle crab.

Regulation 8 adjusts the offences to reflect the changes.
