Customs and Excise Amendment Regulations (No 2) 2002


Note

These regulations are administered in the New Zealand Customs Service.


Pursuant to the Customs and Excise Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • (1) These regulations are the Customs and Excise Amendment Regulations (No 2) 2002.

    (2) In these regulations, the Customs and Excise Regulations 1996 SR 1996/232 are called the principal regulations.

2 Commencement
  • (1) These regulations, except regulations 4 and 5, come into force on the day after the date of their notification in the Gazette.

    (2) Regulations 4 and 5 come into force on 3 February 2003.

3 Content of advance notice of arrival
  • Regulation 12(1) of the principal regulations is amended by revoking paragraphs (c) and (d), and substituting the following paragraphs:

    • (c) in the case of a ship, its originating port, the date of departure from that port, the name of every port it has visited between its originating port and arrival at the Customs place, and the name of every port in New Zealand that it intends to call at; and

    • (d) in the case of an aircraft, the aircraft type, its registration number, the flight identification number, the originating airport, the name of every airport at which it has landed between its originating airport and arrival at the Customs place, its expected date of departure from the Customs place, and the name of every airport in New Zealand that it intends to land at; and

    • (e) with respect to every passenger and every member of crew on a ship or aircraft,—

      • (i) the person's full name, date of birth, gender, and nationality; and

      • (ii) the number of the person's passport or certificate of identity, the state or organisation that issued it, and the city in which it was issued; and

      • (iii) the port or airport at which the person embarked on the ship or aircraft; and

      • (iv) whether the person is disembarking at the Customs place and, if not, the port or airport at which the person is expected to disembark.

4 Certain goods deemed to be entered
  • Regulation 26(1)(b) of the principal regulations is amended by omitting from both places in which it appears the expression 4, 5, and substituting in each case the expression 4, 4A, 5, 5A.

5 Second Schedule amended
  • (1) The Second Schedule of the principal regulations is amended by revoking form 4, and substituting the forms 4 and 4A set out in the Schedule.

    (2) The Second Schedule of the principal regulations is amended by revoking form 5, and substituting the forms 5 and 5A set out in the Schedule.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations amend the Customs and Excise Regulations 1996 (the principal regulations) to effect the following 2 changes:

  • regulation 3, which comes into force on the day after the date on which these regulations are notified in the Gazette, amends regulation 12(1) of the principal regulations to extend the range of information that is required to be given in the advance notice of arrival of every ship and aircraft:

  • regulations 4 and 5 provide for the replacement of the forms to be completed on arrival at a Customs place by international aircrew.
