Land Transport (Offences and Penalties) Amendment Regulations 2003


Note

These regulations are administered in the Ministry of Transport.


Pursuant to section 167 of the Land Transport Act 1998, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

  • (1) Schedule 4 of the principal regulations is amended by inserting in paragraph 4(b) in Part 2 of the form, after the words at the time of driving, the words or operating.

    (2) Schedule 4 of the principal regulations is amended by adding to paragraph 4(b) in Part 2 of the form the following subparagraphs:

    • (iv) if section 96(1A) of the Act applies, the operator operated the motor vehicle in a race, or in an unnecessary exhibition of speed or acceleration, in contravention of section 22A(1) of the Act; or

    • (v) if section 96(1A) of the Act applies, the operator operated the motor vehicle without reasonable excuse in a manner that caused the vehicle to undergo sustained loss of traction in contravention of section 22A(3) of the Act; or.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the commencement of the Land Transport (Unauthorised Street and Drag Racing) Amendment Act 2003, amend the form of the Vehicle Seizure and Impoundment Notice set out in Schedule 4 of the Land Transport (Offences and Penalties) Regulations 1999. The amendments are consequential on the passing of that Act and incorporate in the form further information to ensure that operators of motor vehicles that are impounded are fully informed of their appeal rights.
