Pursuant to section 68(1) of the Medical Practitioners Act 1995, the Minister of Health gives the following notice.

1 Title
  • This notice is the Medical Practitioners (Quality Assurance Activity: General Practitioners' Advanced Vocational Education Programme) Notice 2003.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of quality assurance activity
  • The quality assurance activity called the General Practitioners' Advanced Vocational Education Programme Quality Assurance Activity and described in the Schedule is a quality assurance activity to which Part 6 of the Medical Practitioners Act 1995 applies.

Description of General Practitioners' Advanced Vocational Education Programme Quality Assurance Activity

1 Interpretation
  • In this schedule, activity means the General Practitioners' Advanced Vocational Education Programme Quality Assurance Activity.

2 Sponsor
  • The activity is carried out under the auspices of the Royal New Zealand College of General Practitioners.

3 Persons engaged in activity
  • The persons who engage in the activity are—

    • (a) medical practitioners (in this schedule called candidates) who, with a view to becoming fellows of the Royal New Zealand College of General Practitioners, participate in a programme known as the General Practitioners' Advanced Vocational Education Programme; and

    • (b) fellows of the College who are authorised by the College to assess the clinical practice of candidates (in this schedule called fellows of the College).

4 Nature of activity
  • (1) The activity involves fellows of the College in the performance of the following tasks:

    • (a) obtaining information about the clinical practices of candidates by taking the actions described in subclause (2):

    • (b) giving advice to candidates about any improvements that they need to make to their clinical practices:

    • (c) making recommendations to candidates on how those improvements are to be made:

    • (d) monitoring the implementation of those recommendations.

    (2) The following actions are the actions referred to in subclause (1)(a):

    • (a) visiting the candidate concerned at the candidate's place of practice:

    • (b) inspecting the facilities and equipment used by the candidate in connection with the candidate's clinical practice:

    • (c) reviewing a sample of the candidate's clinical files:

    • (d) observing consultations between the candidate and patients who have consented to being observed:

    • (e) if there is reason to believe that the candidate's treatment of an illness or condition maybe deficient, reviewing how the candidate-

      • (i) responds to the illness or condition; and

      • (ii) records the illness or condition in the candidate's clinical files:

    • (f) obtaining from the candidate written comments on the candidate's involvement in the activity.

5 Objective
  • The objective of the activity is to improve the quality of care provided by medical practitioners.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice declares that the quality assurance activity called the General Practitioners' Advanced Vocational Education Programme Quality Assurance Activity is a quality assurance activity to which Part 6 of the Medical Practitioners Act 1995 applies. The activity will be run by the Royal New Zealand College of General Practitioners, and involves the assessment of medical practitioners who wish to become fellows of the College.

The effect of this declaration is that, subject to certain exceptions,—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the persons who engage in the activity in good faith are immune from civil liability.

Under section 69 of the Medical Practitioners Act 1995, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
