Fisheries (South-East Area Commercial Fishing) Amendment Regulations 2003

These regulations are administered in the Ministry of Fisheries.


Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on the day after the date of their notification in the Gazette.

3 Interpretation
  • (1) Regulation 2(l) of the principal regulations is amended by omitting the words packing house from paragraph (d) of the definition of consumer pack in both places where they occur, and substituting in each case the words licensed fish receiver's premises.

    (2) Regulation 2(l) of the principal regulations is amended by omitting the words licensed fish packing house situated in Otago from paragraph (e) of the definition of consumer pack, and substituting the words licensed fish receiver's premises.

    (3) Regulation 2(l) of the principal regulations is amended by revoking the definition of licensed fish packing house, and substituting the following definition:

    licensed fish receiver's premises means premises—

    • (a) situated in Otago; and

    • (b) the proprietor of which is the holder of a fish receiver's licence granted under the Fisheries (Licensed Fish Receivers) Regulations 1997.

4 Special provisions relating to taking of rock lobster from Otago Concession Area
  • Regulation 6(l)(e) of the principal regulations is amended by omitting the words licensed fish packing house, and substituting the words licensed fish receiver's premises.

5 Processing and sale of Otago Concession Area rock lobster
  • Regulation 7(b) and (d) of the principal regulations is amended by omitting the words licensed fish packing house in each place where they occur, and substituting in each case the words licensed fish receiver's premises.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the day after the date of their notification in the Gazette, amend the Fisheries (South-East Area Commercial Fishing) Regulations 1986.

The amendments omit references to licensed fish packing houses and substitute references to licensed fish receivers' premises.

The amendments, take into account changes that will take place when the Animal Products (Ancillary and Transitional Provisions) Act 1999 repeals the Meat Act 1981, under which licences for fish packing houses are granted.
