Fisheries (South-East Area Commercial Fishing) Amendment Regulations (No 2) 2003

Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Apertures to be incorporated in rock lobster pots
  • Regulation 6A of the principal regulations is amended by revoking subclause (5), and substituting the following subclause:

    • (5) This regulation does not prohibit the use or possession of rock lobster pots without escape apertures on board fishing vessels if—

      • (a) the pots are constructed entirely of spot welded rectangular mesh with inside dimensions of not less than 140 mm long by 38 mm wide; and

      • (b) the pots are used—

        • (i) without covers or liners; or

        • (ii) with covers or liners that leave unencumbered at least 80% of the surface area of each of 2 opposite sides.

4 Regulations 11JC and 11JD revoked
  • Regulation 11JC and 11JD of the principal regulations are revoked.

5 Offences
  • Regulation 12(2) of the principal regulations is amended by omitting the expression 11JC, 11JD,.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the Fisheries (South-East Area Commercial Fishing) Regulations 1986.

The amendments—

  • permit spot welded rectangular mesh rock lobster pots to be used with covers or liners if the covers or liners leave unencumbered at least 80% of the surface of each of 2 opposite sides:

  • revoke the provisions relating to the season and quotas for skate, ray, and spiny dogfish in quota management area 3.
